When the general manager at R15 in Sacramento, Joel York, saw L.A. restaurant Gracias Madre use hemp CBD oil in cocktails, he thought it might be a fun feature to bring to his bar. So, he created “Kronic Aid,” a “boozy strawberry lemonade made from an infusion of pineapple, vodka, hop flowers and the non-intoxicating marijuana extract with a taste similar to skunky olive oil.” 1

And around October 18th, bartenders started mixing and selling the drinks for $10. They were so novel for Sacramento, that the drink itself was going to be the subject of an article in The Sacramento Bee. Everyone loved it.

However, once The Bee called the Sacramento Police Department for comment, an officer from the California Department of Alcoholic Beverage Control (ABC) stopped by R15 and made the manager on duty pull the infusion off the shelf. You see, the ABC forbids licensed alcohol sellers from mixing CBD oil into drinks or food. Why? It might be dangerous.

That’s right. The same stuff that you can buy off the internet that study upon study shows it perfectly safe, might be dangerous. No, it didn’t matter that people could buy it from Sacramento’s Natural Foods Co-Op’s wellness section. It didn’t matter that you don’t need a prescription to buy it, either. No, you don’t even need to show proof of age to buy it, but it might not be safe.

According to ABC regulation,

“Until the FDA rules that industrial hemp-derived CBD oil and CBD products can be used as a food or California makes a determination that they are safe to use for human and animal consumption, CBD products are not an approved food, food ingredient, food additive, or dietary supplement.

ABC licensees may not manufacture, produce, or sell CBD or CBD products, or any products that contain CBD. It does not matter if the CBD comes from industrial hemp or from cannabis. This also includes nonalcoholic beverage products and edibles.”2

York is disappointed but being the true craftsman that he is, he just plans to come up with something else for his customers.

To date, somehow, hemp remains federally illegal. But a DEA spokesman told Indianapolis TV station WTHR in November that they won’t go after CBD users and urged the state not to, either.3

Well, at least there’s that.
