A $21.5 million settlement between Monsanto Co. and a class of consumers over allegedly misleading labels on concentrated versions of Roundup weedkiller was affirmed by the Eighth Circuit on August 20, shooting down an objector’s arguments that the size of the deal was inflated.

The panel rebuffed arguments to the deal brought by objector James Migliaccio, ending claims that Monsanto misled consumers about how much Roundup could be made from bottles of concentrate. Migliaccio had argued the lower court used “grossly inaccurate figures” that led it to misjudge the overall value of the settlement. However, Chief Judge Lavenski R. Smith wrote for the U.S. Court of Appeals for the Eighth that the objector failed to show the trial court erred in approving the settlement and a $6.2 million fee award to class counsel.

More than 70,000 consumers who made valid claims will receive full reimbursement for the products they bought, totaling $10.7 million.

In 2015, Monsanto made nearly $4.76 billion in sales and $1.9 billion in gross profits from herbicide products, mostly Roundup.
